Jan Stenbeck was the smartest person I ever met. Not smart in the way academics are smart. Smart in the way that changes the world. He saw what nobody else saw. He understood that mobile telephony would revolutionise countries that hadn't even laid copper wire yet. He broke state socialist monopolies when everyone said it was impossible. He built empires out of ideas.

Every day Jan received a binder. Two people read all the world's important newspapers and magazines for him and pulled out what mattered. The things others missed. The faint signals that foreshadow great change.

I worked with Jan. I learned from him. And I have never forgotten that binder. JansBrief is my tribute to him, a modern version: global, AI-driven, available to everyone with ambition.

Montana becomes America's first state to let companies sell experimental drugs directly to consumers

As of this week, Montana has created something that exists nowhere else in the United States: a legal pathway for biotech companies to sell experimental drugs directly to consumers without full FDA approval. Any company whose treatment has completed preliminary safety testing — in some cases involving as few as ten healthy volunteers — can now pay $12,500 to apply to a newly established state review board. Once approved, the drug can be marketed and sold to Montana residents.

The mechanism bypasses the federal regulatory architecture that has governed pharmaceutical development since 1962, when Congress granted the FDA authority to require proof of both safety and efficacy before a drug reaches the market. Montana's law does not formally challenge FDA jurisdiction — it operates in a grey zone, exploiting the fact that states have broad authority over healthcare delivery within their borders. But the practical effect is unmistakable: a parallel drug approval system now exists in the United States, and it is open for business.

The law's supporters describe it as a lifeline for patients with terminal or rare diseases who cannot wait years for clinical trials to conclude. They point to cases where promising treatments languish in regulatory limbo while patients die. The argument has emotional force and, in specific cases, empirical backing. Some drugs that eventually gained FDA approval did take unconscionably long to reach patients. The HIV/AIDS crisis produced the most searing examples, and the memory of that failure animates much of the current push for accelerated access.

But the structural implications go far beyond compassionate use. Montana has created an economic incentive for companies to route their products through a state board rather than the FDA. The $12,500 application fee is a fraction of what federal approval costs. The evidentiary bar — preliminary testing in a small number of healthy people — does not demonstrate whether a drug works, only whether it causes immediate harm in a controlled setting. Efficacy, the question that matters most to patients, is not required.

The pharmaceutical industry's response has been carefully muted. Major drugmakers, which depend on FDA approval for market access and liability protection, have distanced themselves. But smaller biotech firms and supplement companies — some of which have long chafed at federal oversight — are watching closely. If Montana's model survives legal challenge, other states will follow. Texas, Florida and Arizona have similar legislation in draft.

The deeper tension is philosophical. The FDA's approval process is slow, expensive and sometimes captures the very industries it regulates. But it exists because the alternative — a market in which unproven treatments are sold to desperate people — has been tried before, and the results were catastrophic. The patent medicine era of the nineteenth century, in which manufacturers sold radium water and mercury compounds as cures, ended only when federal regulation intervened. Montana is not returning to that era. But it is testing whether the safeguards that replaced it are necessary or merely habitual.

The experiment is now live. The first applications are expected within weeks. The consequences — for patients, for the pharmaceutical industry, and for the federal government's role in protecting public health — will take years to become clear.

Now — The FDA's authority faces its most serious challenge in sixty years: Montana's law is not an isolated provocation. It is the sharpest edge of a broader movement to decentralise drug regulation in the United States. Right-to-try legislation, which allows terminally ill patients to access drugs that have passed Phase I trials, was signed into federal law in 2018 but has been used sparingly because it still requires manufacturer cooperation and offers no liability protection. Montana's approach goes further: it creates a state-administered approval process with commercial incentives. The immediate effect is to establish a competing regulatory authority. If companies begin routing products through Montana — and if patients travel there or order remotely — the FDA faces a choice between enforcement action that will be portrayed as blocking access to medicine, or acquiescence that will erode its gatekeeping function. Neither option is costless.

Soon — The liability framework for medicine fractures along state lines: Within two years, the question of who is responsible when an experimental drug harms a patient will become urgent. Under the current system, FDA approval provides a degree of legal protection for manufacturers — the so-called regulatory compliance defence. Drugs sold under Montana's framework will not have that shield. Patients who suffer adverse effects will sue. Manufacturers will argue that patients consented to the risk. Courts will have to decide whether state-level approval constitutes a meaningful regulatory standard or merely a filing fee dressed up as oversight. The answers will vary by jurisdiction, creating a patchwork of liability rules that makes the US pharmaceutical market harder to navigate for companies and more dangerous for patients. Insurers, meanwhile, will have to decide whether to cover treatments approved by a state board but not by the FDA. Most will not.

Later — The global pharmaceutical regulatory order begins to fragment: The FDA's approval process is not merely an American institution. It is the benchmark against which most of the world's drug regulators operate. The European Medicines Agency, Japan's PMDA and regulators across Asia and Latin America routinely defer to FDA decisions or use them as reference points. If the FDA's domestic authority is weakened — if American patients can legally access drugs that the FDA has not approved — then the signal value of FDA approval diminishes for everyone. Countries that have relied on American regulatory rigour as a proxy for their own will need to build independent capacity or accept greater risk. The chains of generosity transforming kidney donation

In 2020, Mark Scotch walked into a bar and left — eventually — with one fewer kidney. That is how he tells the story, though the truth is more remarkable than the punchline. A chance conversation led Scotch, then sixty-four, to donate a kidney. But not to the person he met. His kidney went to a stranger, setting off a chain of transplants in which each donor gave an organ to someone they had never met, unlocking a match for the next person in the sequence.

These are kidney exchange chains, and they are quietly transforming organ donation in the United States and beyond. The principle is elegant: when a willing donor is incompatible with their intended recipient, the pair enters a pool. An algorithm matches them with another incompatible pair, and the kidneys cross over. In longer chains, a single altruistic donor — someone like Scotch, who gives without expecting a return — can trigger a cascade of transplants, each one unlocking a match that was previously impossible.

The chains are growing. Some now stretch to dozens of transplants across multiple hospitals and states, coordinated in real time by software that manages blood types, antibody profiles, surgical schedules and transport logistics. The longest recorded chains have saved more than thirty lives from a single initiating donation.

What makes this story worth sitting with is not the medical engineering, impressive as it is. It is the moral architecture. The system works because it converts a bilateral transaction — I give to you, you give to me — into a network of asymmetric generosity. No donor in the chain receives anything. Each gives to a stranger on the faith that someone else, somewhere else in the sequence, will give to the person they love. It is a market mechanism built entirely on trust, coordinated by mathematics but powered by something algorithms cannot generate.

The waiting list for kidneys in the United States alone exceeds 90,000 people. Dialysis — the alternative — costs roughly $90,000 per patient per year and offers a diminished quality of life. Every chain that runs successfully does not just save lives; it saves the healthcare system millions of dollars. The economics are overwhelming. The obstacle is not money or medicine. It is the willingness of people to give a piece of themselves to someone they will never know.

Jan would have liked this because it is a design problem solved by generosity — and because the solution scales.

That is how many climbers — including the renowned Nepali mountaineer Nirmal "Nims" Purja — are feared missing after an avalanche struck in Pakistan's Karakoram range. The group includes an American, a Chinese national, an Omani and five Nepalis, along with Purja, who became famous for summiting all fourteen of the world's 8,000-metre peaks in just over six months.

The number is small. Ten people. In a world of eight billion, it would not ordinarily command attention. But it illuminates a phenomenon that is growing harder to ignore: the industrialisation of extreme mountaineering. What was once the domain of a handful of elite climbers supported by national expeditions has become a commercial industry. Guided ascents of peaks that would have been considered suicidal a generation ago are now marketed to wealthy amateurs. The routes are more crowded than ever. The margins for error have not changed.

Pakistan's northern mountains — K2, Nanga Parbat, Broad Peak and their satellites — are among the most dangerous on Earth. Avalanche risk is inherent and irreducible. Climate change is making it worse: warming temperatures destabilise ice seracs and snowfields that were once considered stable, making traditional route assessments unreliable. The same glacial retreat that is shrinking water supplies for millions downstream is loosening the frozen architecture on which climbing routes depend.

Purja's presence in the missing group adds a particular dimension. He is not a tourist. He is one of the most accomplished high-altitude climbers alive, holder of multiple speed records, and a figure who has done more than almost anyone to bring Nepali Sherpa climbers into the foreground of mountaineering's public narrative. If an avalanche can take him, it can take anyone — which is, of course, the point. Mountains do not grade on reputation.

Search and rescue at extreme altitude is constrained by the same conditions that caused the disaster. Helicopter operations above 6,000 metres are marginal. Ground teams move slowly. Weather windows are narrow and unpredictable. The families of the missing are waiting. The mountains are indifferent.

8 — Today's Wisdom

Montana has just created a parallel system for drug approval. Twelve and a half thousand dollars, a handful of healthy test subjects, and your experimental drug can be sold directly to consumers without the FDA having said a word. They call it freedom. I call it something else.

I've been building companies my whole life. I believe in deregulation, in shifting power from bureaucrats to people who build things. But there is a crucial difference between removing unnecessary barriers to innovation and removing the floor from under people who can't assess what they're swallowing. Drugs are not apps. You can't ship a beta version and fix the bugs after launch, because the bugs here are organ failure and death.

The beauty of the American model, when it works, is that it demands proof. Not promises, not testimonials, but data. It takes too long sometimes, absolutely. The FDA needs to be reformed, not circumvented. What Montana is building is not a faster path to better medicine. It's a cheaper path for bad actors to reach desperate people with unproven products.

Desperation is the worst possible basis for a purchasing decision, and exploiting it is not entrepreneurship. It's the kind of thing that gives entrepreneurship a bad name. Real innovation can handle proving that it works before it's sold.
